Credit Simple – Crack the Code

  1. These terms and conditions of entry, including information on how to participate and prize details (Promotion Terms), apply to the ‘Crack the Code’ Promotion (Promotion) and entry into the Promotion is deemed acceptance of these Terms.
  2. The Promoter is The Lending People Limited (TLP).
  3. The Prize Indemnifier is OddsOn Promotion Ltd.
  4. The Prize is $50,000 cash.
  5. The Promotion will run from 1 June 2019 to 31 May 2020.
  6. Entry is exclusive to Credit Simple New Zealand members.
  7. A Qualifying Entry is an individual who;
    1. Clicks on the hyperlink contained within the ‘Credit Simple Offer’ and;
    2. Applies for finance through or or  and;
    3. Is approved and draws down the loan during the Qualifying Purchase Period. and;
    4. Is one of the 20 individuals randomly selected that meets the above criteria.
  8. The Promotion Qualifying Purchase Period commences at 12.01am on the first day of the calendar month and ends at 12.00pm on the last day of the calendar month. (Qualifying Purchase Period).
  9. Entry is only open to individuals who are 18 years or over on the date of entry and who are resident in New Zealand. Employees and immediate families of TLP, Credit Simple, Illion and Oddson Promotion Ltd and their associated companies are ineligible to enter.
  10. At the end of the Qualifying Purchase Period, TLP will collate all Qualifying Entries and email instructions and a link to enter a 4-digit code for a chance to win the Prize.
  11. Qualifying Entries will have 72 hours to guess the digits to ‘Crack the Code’ (Promotional Guess Period).
  12. In the email that is sent to Qualifying Entries it will detail how to crack the code.
    1. This is via a website portal listed in the email.
    2. Qualifying Entries will be prompted to enter a 4-digit pin to exactly match the code and submit
    3. The winning entry will correctly guess the 4-digit code that exactly matches the 4- digit code pre-selected by the Indemnifier. This represents the ‘Crack the Code’.
  13. To successfully win a Prize you must be the first person to accurately guess the 4-digit numerical code before any other participant.
  14. Should more than one exact match code be entered the first valid and successfully submitted matching entry will win. If no winning codes are entered, no prize is awarded.
  15. Incomplete or indecipherable entries will be deemed invalid.
  16. Where multiple entries from one participant are submitted, only the first entry will be a valid entry.
  17. The Prize will be awarded as follows:
    1. The Indemnifier will send TLP the sealed Master Envelope enveloped documents containing the winning combination at the start of the Promotional Guess Period. The winning combination will also be held by the Indemnifier.
    2. At the end of the Promotional Guess Period the Indemnifier shall provide TLP with a copy of the entire database of entries, and the Indemnifier will verify if there is a code match.
    3. The first entry with the exact match of the code held by TLP will be determined as the winner.
    4. The winning code combination will be verified by the Indemnifier.
    5. Subject to any directions from a regulatory authority, all Qualifying Purchase Entries will be recorded by TLP and be made available to the public for inspection on request.
  18. The Prize will be available to the winner for collection in the month following the date the Prize is determined and paid to a nominated bank account provided by the winner.
  19. The winner of the Prize will be notified by telephone and email within one week of the end of the Qualifying Purchase Period.
  20. Prizes are not transferable, or exchangeable. Prizes must be taken as offered and may not be varied. If for any reason a winner does not take a Prize by the time stipulated by TLP, then the Prize will be forfeited.
  21. Independent financial advice should be sought by winners as tax implications may arise as a result of accepting the Prize.
  22. Decisions of TLP on aspects of the prize determination are final and no correspondence will be entered into.
  23. TLP reserves the right to cancel or amend any aspect of the “TLP ‘Crack the Code’ Promotion” at any time, including the Prize.
  24. By entering the Promotion all entrants agree that if they correctly guess the correct code, they will undertake all reasonable steps required by TLP and the Indemnifier to receive the Prize and acknowledge that the Prize will not be available until these requirements have been met to the satisfaction of TLP and the Indemnifier.
  25. As a condition of accepting a Prize, each winner must sign any legal documentation as and, in the form, required by TLP in their absolute discretion, including but not limited to a participation agreement including a legal release and indemnity form.
  26. Entrants consent to TLP using their name, likeness and/or image in the event they are the winning entrant (including photograph, film and/or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting the Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by TLP.
  27. Nothing in these terms’ limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Consumer Guarantees Act 1993 (New Zealand), as well as any other implied warranties or similar consumer protection laws in New Zealand (“Non-Excludable Guarantees”).
  28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, TLP (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
    1. any technical difficulties or equipment malfunction (whether or not under TLP’s control);
    2. any theft, unauthorised access or third-party interference;
    3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by TLP) due to any reason beyond the reasonable control of TLP;
    4. any tax liability incurred by a winning entrant; or (e) use/taking of a prize.
  29. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the control of TLP, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, TLP reserves the right in its absolute discretion to take any action that may be available to it, subject to national regulations, including cancelling, terminating, modifying or suspending the Promotion or disqualifying any entrant.
  30. Any entrant who, in the opinion of TLP, tampers or interferes with the entry mechanism or draw in anyway, engages in any unlawful or improper conduct which jeopardizes or is likely to jeopardize the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
  31. TLP reserves the right to disqualify entries in the event of non-compliance with these Terms. TLP’s decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.
  32. TLP must receive entries during the Qualifying Purchase Period. TLP accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. TLP has no control over mobile telephone or internet communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. TLP is not liable for any consequences of user error including (without limitation) costs incurred.
  33. TLP collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities. TLP (and its agencies) will also use and handle personal information as set out in its privacy policy, which can be viewed at Entry is conditional on providing this information. By entering the Promotion, unless otherwise advised by the eligible entrant, each eligible entrant consents to the information they submit with their entry being entered into a database and being held in a server located in New Zealand. In addition to any use that may be outlined in TLP’s privacy policy, TLP may use this information in any media for future promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the eligible entrant, without any further reference or payment or other compensation to the eligible entrant. All personal details of the eligible entrants will be stored at the office of TLP and held in a server located in New Zealand. A request to access, update, opt out or correct any information should be directed to TLP’s office. Any complaints regarding the treatment of personal information should also be directed to that office and will be dealt with by TLP in accordance with its privacy policy. All entries become the property of TLP. The prizes do not include any charges associated with the connection or use of the prize.
